Privacy notice

1. Who we are
This website belongs to Smyrna Digitale, a trading name of Smyrna Bouw, a Dutch sole proprietorship (Chamber of Commerce/KVK number 72332050). Smyrna Bouw is the data controller. Address: Salignahout 14, 2719 KG Zoetermeer, Netherlands. Contact: info@smyrnadigitale.com.
2. Visiting the website
This website has no forms, accounts, analytics, trackers or embedded third-party content. It sets no cookies. On websites on a free plan, Netlify automatically adds a small "Powered by Netlify" badge. If you choose to hide that badge, only your own browser remembers that choice (in localStorage); according to Netlify, no data is sent when you do so. Otherwise the website stores nothing in your browser. On each visit our hosting provider Netlify processes technical data, such as IP address, time, requested page and browser details, to deliver and secure the website. We do not use this data to track visitors or build profiles. Legal basis: our legitimate interest in a secure, working website (Article 6(1)(f) GDPR).
3. If you email us
If you email us, we process your name and email address, your message and any information you choose to include, in order to answer you. Legal basis: steps taken at your request before a possible contract (Article 6(1)(b) GDPR), or our legitimate interest in answering business enquiries (Article 6(1)(f) GDPR). You are not obliged to give us any data; without an email address we simply cannot reply.
4. Retention periods
We retain personal data only for as long as necessary for the purposes for which it was collected.
General information enquiries and routine email correspondence are retained for a maximum of 12 months after the enquiry has been resolved.
Correspondence relating to quotations, business discussions and customer relationships may be retained for as long as the relevant process or business relationship continues. We periodically review whether continued retention remains necessary.
We retain invoices and basic accounting records for 7 years in accordance with Dutch tax legislation. Where the law requires a longer retention period in specific circumstances, the applicable statutory period applies.
Data necessary for the establishment, exercise or defence of legal claims may be retained for longer where a valid legal basis continues to apply.
Personal data that is no longer necessary is deleted or anonymised.
Technical access data is processed by Netlify in accordance with its retention policies and applicable contractual terms.
5. Service providers and transfers outside the EEA
We use two processors. Netlify, Inc. (United States) hosts the website. Netlify serves pages through a global network, so technical data may be processed outside the European Economic Area (EEA). According to Netlify, it participates in the EU-U.S. Data Privacy Framework and also uses the European Commission's Standard Contractual Clauses. Hostinger hosts our business email; according to Hostinger, mailboxes and backups are stored in data centres in France and Germany. Hostinger uses sub-processors, including companies in the United States; any transfer outside the EEA is then based on the Standard Contractual Clauses. The data processing terms that form part of each provider's terms of service apply. Email us if you would like more information about these safeguards. We do not sell personal data or share it for marketing.
6. No automated decisions
We do not make decisions about you based solely on automated processing, and we do not build profiles.
7. Your rights
You can ask us for access to, correction, deletion, restriction or transfer of your data. You can also object to processing based on our legitimate interest. Email info@smyrnadigitale.com. We will respond within one month. For a complex or large request we may extend this by up to two further months; if so, we will tell you within the first month and explain why. Requests are free of charge. Where necessary, we will ask you to confirm your identity in a simple way. Some rights do not always apply in full, for example where the law requires us to keep data.
8. Complaints
If you are unhappy with how we handle your data, please tell us. You can also lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
9. Changes
If our website or processing changes, we will update this privacy notice. The date at the top shows when it was last updated.
